The lease agreement:

A lease agreement is signed in order to protect the rights of the real estate owner and tenant. And it is better to arrange the lease in a reputable real estate company to understand all the terms.. Especially if you do not speak Turkish.

Things that need to be mentioned in the lease:

  1. The exact address of the property being traded.
  2. The type of property for rent (commercial, residential, etc.).
  3. Details of the landlord info (name, national number, exact home address, etc.).
  4. Details of the tenant info (name, passport number or TC residence card).
  5. Date of contract.
  6. Mention of the household items and the condition of each.

Terms of the lease:

  • The lease contract must include a set of matters:
    • Personal data of both parties (name, ID number, date and place of birth…).
    • The date of the lease commencement.
    • The value of the rent as the rent value must be clearly stated in the contract. Moreover, it is necessary to specify the date of payment of the rent and to mention how the payment will be made (manually, an account in the bank, through a real estate office).
    • Cleaning revenues, recreational facilities revenues, and other additional revenues that the tenant may have to pay.
  • Moreover, the lessor must pledge in the tenancy contract that there are no previous accrued dues.. Such as bills or other fees.
  • Additionally, the tenant is obligated to pay an insurance amount and it must then be mentioned in the contract. The insurance is the same as the rent and is paid once. The tenant takes the insurance amount if he leaves the house as clean as he receives.
  • It is important that the two parties agree on a specific amount of the annual rent increase.. And to mention that in the contract. This increase is annual and does not exceed 25% of the rental value. This is according to the Turkish Statistical Authority. The authority confirmed that any property owner who exceeds the mentioned percentage will expose himself to legal accountability.
  • It is worth noting that both parties must sign the contract.

When does the landlord have the right to evict the tenant:

  1. When the period stipulated for the tenant’s use of the property expires, the landlord has the right to take out the tenant, unless both parties want to renew the contract. The landlord has the right to evict the tenant in the event of repeated delay in paying the rent.
  2. Moreover, the landlord has the right to terminate the lease when he wants to sell the property. However, he must send a notice to the tenant within a maximum period of one month from the date of transfer of ownership of the property.
  3. The owner of the property has the right to carry out the necessary repairs or restructuring of the property to preserve the value of his property. However, in this case, it is forbidden to rent the property to anyone other than the old tenant, and this prohibition is valid for three years.
  4. Furthermore, the landlord can terminate the rental contract in case he needs the property for himself or for one of his relatives of the first class for the sake of housing. In this case, he is not entitled to rent this property to another tenant other than the old tenant for three years, according to landlord tenant rights in Turkey.

The rent increase rate in Turkey 2023:

One of the most important rental laws in Turkey that regulates dealing between the tenant and the owner is that the property owner has no right to raise the legal rent rate on the tenant more than the increase announced in accordance with the Turkish Debt Law.

Moreover, the owner does not have the right to raise the rent value before the lapse of one year from the contract, but he has the right to file a lawsuit to increase the rent in the event that the rent value is low and does not match the rent value of real estate in the area.

It is worth noting that The Turkish authorities have limited rent increases to a maximum of 25 per cent for 2023 amid continuing increases caused by the ongoing economic crisis in the country.
